Wyld Bub – Terms of Service & Product Safety Disclaimer Effective Date: 29 JUL 2023

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you ("you", the customer) and Nowi Group Pty Ltd, trading as Wyld Bub ("Company", "we", "our", or "us"), concerning your access to and use of the website https://www.wyldbub.com and any related services or platforms (collectively, the "Site").

By using the Site, placing an order, or engaging with Wyld Bub’s services or products, you agree to be bound by these Terms of Service and any applicable policies referenced herein, including our Messaging Terms, Privacy Policy, and Product Safety Policy.

If you do not agree to these terms, please refrain from accessing or using the Site.

Our Site is intended for use by individuals aged 18 years and older. By making a purchase, you confirm that you are legally eligible to enter into this agreement.

2. INTERNATIONAL CUSTOMERS

We are committed to ethical sourcing. We have verified with our suppliers that no child labour is used in the manufacturing of our products.

Please note: All orders are fulfilled from our partner warehouses in China for all customers, regardless of their location. Delivery timeframes may vary depending on your country’s customs clearance and logistics providers.

Wyld Bub ships products worldwide. You are responsible for compliance with local laws, including import duties, taxes, safety regulations, and child product standards. You use our products at your own discretion, and Wyld Bub disclaims liability for failure to comply with local laws in your jurisdiction.

Our manufacturers may provide product safety certifications (such as EN71, ASTM, or ISO standards) which reflect factory compliance, not legal approval for all jurisdictions. Manufacturer-issued certifications are available upon request. Wyld Bub does not warrant the completeness or enforceability of such certifications in any specific legal jurisdiction. It is your responsibility to determine suitability and legal acceptance in your country.

International customers are responsible for any customs duties, VAT, or import taxes applicable in their destination country.

3. INTELLECTUAL PROPERTY

All content, logos, product names, images, and design elements on the Site are the intellectual property of Wyld Bub or its licensors and are protected under international copyright, trademark, and design laws. You may not reproduce or distribute any content without express written permission.

4. PRODUCTS & USAGE

Wyld Bub creates premium, often handcrafted baby products including but not limited to:

  • Personalised clothing

  • Baby carriers

  • Wooden carousels

  • Baby mobiles

All products must be used strictly according to the provided instructions. Misuse may lead to injury, damage, or malfunction. We reserve the right to discontinue or modify any product at any time without prior notice.

5. PRODUCT SAFETY POLICY

The safety of your child is paramount. However, by purchasing from Wyld Bub, you acknowledge and accept that:

  • Adult supervision is always required

  • Products must only be used for their intended purpose

  • All care, maintenance, and installation instructions must be followed

Wyld Bub disclaims liability for any injury, loss, or damage arising from:

  • Failure to follow safety guidelines

  • Modification of the product

  • Use in violation of age or weight recommendations

  • Accidents after delivery

5.1 Baby Carriers

  • Not suitable for babies under 3 months or who cannot hold their own head

  • Not to be used during high-risk activities (e.g., running, cycling)

  • Always ensure baby's airway is clear

  • Stop use immediately if stitching, straps, or buckles show wear

5.2 Wooden Carousels

  • Intended as decorative heirlooms, not toys

  • May contain small parts – choking hazard for children under 3 years

  • Keep out of reach of children

  • Handle with care; avoid moisture and direct sunlight

5.3 Baby Mobiles

  • For visual stimulation only

  • Must be securely mounted out of reach

  • Remove once child can sit up or reach

  • Inspect frequently for loose threads or components

6. PAYMENT & ORDERS

All purchases must be paid in full at the time of order. We accept major payment methods supported by Shopify Payments. Pricing is in the selected currency and may vary by location. Wyld Bub reserves the right to cancel or limit orders at its sole discretion.

7. RETURNS & FAULTY PRODUCTS

If a product is found to be faulty due to a manufacturing issue:

  • We will offer a replacement or refund, subject to photo evidence and report within 14 days of receipt.

  • We do not cover damage due to misuse, wear and tear, or failure to follow care instructions.

8. LIMITATION OF LIABILITY

This limitation of liability does not affect your statutory rights under the laws of your country of residence, including your right to a refund, repair, or replacement under the EU Consumer Rights Directive, where applicable.

To the maximum extent permitted by applicable law, Wyld Bub and its directors, employees, and agents shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Injury, loss, or death caused by improper use of our products

  • Claims exceeding the purchase price of the product

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL), or applicable consumer protection laws in your country of residence, where such rights cannot be lawfully excluded.

Some jurisdictions may not allow such limitations. Where excluded by law, our liability is limited to the minimum extent required.

9. GOVERNING LAW

These Terms shall be governed by and construed under the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Queensland for any disputes, regardless of your country of residence.

If you are a resident of the United States, by using this site or purchasing from Wyld Bub, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or the products sold shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA), and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

This arbitration agreement is intended to be broadly interpreted and applies to all disputes, including but not limited to those arising out of or relating to any aspect of the relationship between you and Wyld Bub, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.These Terms shall be governed by and construed under the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Queensland for any disputes, regardless of your country of residence.

10. MESSAGING & MOBILE TERMS

Wyld Bub may offer mobile messaging services for order notifications, promotions, and marketing updates. By providing your mobile number and opting in, you consent to receive SMS or text communications from Wyld Bub. Message and data rates may apply. You may opt out at any time.

11. FORCE MAJEURE

Wyld Bub shall not be held liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, labor strikes, supply chain disruptions, government orders, or internet and telecommunications outages.

13. EU RIGHT OF WITHDRAWAL

If you are a resident of the European Union, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason.

To exercise your right of withdrawal, you must notify us in writing within the 14-day period via email at hello@wyldbub.com. The product must be unused, in its original packaging, and returned at your expense unless faulty.

If eligible, we will refund the full purchase price (including original shipping costs, if applicable) within 14 days of receiving the returned item or proof of return.
